FULLY AND FAITHFULLY SUPPORTING AN ARTICLE V CONVENTION OF THE STATES
The founders were brilliant men, they placed within the Constitution a fail safe for the American people to rein in an out-of-control Federal Government. Let us start by explaining exactly what the Article V Convention is:
Article V of the Constitution reads as follows:
“The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention of proposing Amendments, which in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several states, or by Conventions in three fourths thereof, as the one of the other Mode of Ratification my be proposed by the Congress…”
In a nutshell, Article V lays out HOW the Constitution can be amended (how amendments can be added to the text of the Constitution). Article V provides two distinct paths to do this:
-
Congress proposes an amendment to the States with two thirds of each chamber voting to adopt it; the states must vote with three fourths agreeing to it as well, should this happen, the amendment is ratified, and the text is placed into the Constitution. This has been the process for all the Amendments added to the Constitution so far.
2.The States may BYPASS CONGRESS by calling a convention, this requires the passing of legislation that calls for a convention in 34 states, at this convention a pre-determined set of amendments would be debated and discussed and eventually voted on by the state delegations. The amendments that are passed would then be sent to all 50 state legislatures requiring 38 states to vote in favor of the new amendments, if 38 or more states vote in favor, the Amendments are added to the Constitution WITH NO SAY FROM CONGRESS OR THE FEDERAL GOVERNMENT.
It is this second path that the Article V movement is concerned with and already is in progress, as of this writing the current state of the Article V movement looks like this:
Currently, 15 states have successfully PASSED the COS resolution and another 8 have passed it in one chamber and another 9 have introduced legislation, if we can successfully pressure and push with 80 million Americans with us, we will have the 32 of the 34 states we need to call a convention, so lets look at what types of amendments would be discussed and how the convention process would work.
The official COS movement’s website provides a clear and concise process that will be followed and sets out a list of amendments to consider which would possibly include:
-
Congressional Term Limits
-
Balanced Budget Amendments
-
Limits on federal Spending
-
Limits on Taxation and adoption of new tax systems
-
Removing the Federal Government from:
-
Education
-
Healthcare
-
-
Stopping unelected federal bureaucrats from imposing regulations.
-
Setting Term Limits for SCOTUS judges and capping the number of justices at nine so no radical senate can pack the courts.
-
Term Limits on federal positions ending the influence of 30+ year bureaucrats that make the deep state and swamp so dangerous.
-
Stop the aggressive seizure of state land and force the federal government to return land to the states.
These are just the guidelines to what would become specific language that would be agreed upon as the only subjects allowed to be discussed at the convention and the only subjects that will be debated and voted on to send to the states for ratification. Many have attempted to thwart the COS movement by using a term of “runaway convention” meaning that if we call a convention many liberal states will use the opportunity to propose things like repealing the second amendment or adding insane positions to the constitution like abortion on demand, the founders built a safeguard in so that only amendments with the overwhelming support of the American people are added because all amendments that pass the convention still must be passed by 38 states.
A convention of the states is the last best hope we have to rein in an out-of-control federal government, and the founders gifted it to us for this exact time in our history, we must not, in our moment of opportunity to save a nation, cower and just hope things get better, things will be better, but we have to work to make them better. Government will never rein itself in, it will never give you back your liberty, you must take it back.
